Berger, the legislature and the Republicans won. Berger on Wednesday, July 27 introduced a bill that specifies districts, creating a Republican-friendly district map for Guilford County, and forbids the Board of Commissioners from holding a referendum to change the districts before July 1, 2017 – stopping in its tracks Alston's plan to hold a referendum to keep the Board of Commissioners with nine districts and two at-large members. Earlier bills filed by Berger and District 62 state Rep. John Blust required eight districts and one at-large member. That allowed the Guilford County commissioners with a seven-to-four Democratic majority to draw the lines.

Berger's latest bill was ratified the day after it was filed, making any plans for a referendum moot and making it impossible for any of the dozen or so district maps submitted in Guilford County to be accepted at the state level. Berger's districts must still be approved by the US Department of Justice (DOJ) under the Voting Rights Act of 1965, and supporters of maps other than Berger's can submit them to the DOJ. But the DOJ has a limited mandate and can reject a map only if it dilutes minority voting power, not simply to settle an internal political squabble in Guilford County.

Republicans said Berger filed his bill – despite having an agreement with Alston to reduce the number of Guilford County commissioners to nine, and letting the current Board of Commissioners draw the districts – because Alston overreached with his evident plan to have a referendum to keep the number of commissioners at 11. They said the map Alston submitted to the commissioners was as raw a piece of gerrymandering as Berger's.

The redistricting issue came up before the districts represented by three Guilford County commissioners who live in the City of Greensboro."
